Section 37. Sentence.

(1) In passing sentence upon a person convicted of an offence, a Court shall take into consideration the period during which the said person was remanded in custody, and may treat such period as part of the period of imprisonment to be served by the said person under the sentence.

(2) A sentence of imprisonment may be imposed in default of payment of a fine imposed under this Enactment, but such sentence shall not exceed-

(a)

one half of the term of imprisonment provided for the offence; and

(b)

seven days, in any case where no term of imprisonment is provided for the offence.
