Section 72. Declaration of status of unmarried.

(1) Any person who is a convert may apply to the Court of Kadhi having jurisdiction in a place where he or she resides for a declaration that he or she is unmarried in accordance with Hukum Shara'.

(2) No such declaration shall be pronounced by the Court save in accordance with the provisions of Hukum Shara' and in pursuance of the evidence of such person and other witnesses, if any, given on oath or affirmation.

(3) Upon pronouncing such declaration the Kadhi shall register the same and shall issue a certificate thereof in the prescribed form to such person.
