Procedure in Criminal Proceedings

Section 64. Prosecutor.

The prosecution shall be conducted-

(a)

by any person appointed in writing by His Highness the Sultan to prosecute,

(b)

by any person appointed by the Majlis to prosecute,

(c)

by the Public Prosecutor or his Deputy,

(d)

by a Police Officer or Penghulu,

(e)

by the Imam of the

kariah

within which the offence was committed, or

(f )

by the complainant.

None of such persons shall be entitled to prosecute if any person mentioned before him in the preceding list is available and willing to do so.
