Section 49. Cautions and binding over.

In lieu of convicting any person the Court may caution and discharge him, and in lieu of sentencing any person convicted the Court may make an order binding him over to be of good behaviour for a period not exceeding one year and may accept a bond in any sum with or without sureties or the deposit of a sum of money. On a breach of the terms of any such bond being proved, the Court may order it to be enforced as if the amount due thereon were a fine. An appeal shall lie from any such order.
