Section 114. Appointment of persons to solemnize and register marriage and divorce.

(1) The Yang di-Pertuan Agong may appoint any fit and proper Muslim to be Registrar of Muslim Marriages and Divorces in any place.

(2) The Kathi Besar, and every Kathi shall be ex-officio Registrars of Muslim Marriages and Divorces for the whole of the areas in which they respectively have jurisdiction in criminal and civil matters.

(3) The Imam of every mosque shall be ex-officio Registrar of Muslim Marriages and Divorces for the kariah of his mosque.

(4) Registrars of Muslim Marriages and Divorces shall have such rights and powers and perform such duties as may be conferred or imposed upon them by this Enactment or any rules made thereunder.

(5) Registrars of Muslim arriages and Divorces shall be deemed to be public servants for the purposes of the Penal Code.
