PART VIII - MARRIAGE AND DIVORCE
Section 86. Marriage of Janda.
(1) As respects of a janda the following provisions shall apply, that is to say-
(a) she shall not be married to any person, prior to the expiration of the period of eddah;
(b) she shall not be married unless there is produced-
(i) a certificate of the death of her late husband or a certificate of divorce lawfully issued under the law for the time being inforce, or, a certified copy thereof;
(ii) a certificate issued by the Court having jurisdiction in the place where she resides, certifying that she is a janda;
(c) where she was divorced with three "talaks" and she is to be married to the person from whom she was so divorced she must have been lawfully married to some other person, such marriage having been consummated and later lawfully dissolved.
(2) As respects a marriage under paragraph (c) of sub-section (1), the Kathi may if he is satisfied that there has been any collusion between the person from whom she was divorced with three "talaks" and the said other person to whom she was married after such "talaks", annul the marriage.
