COUNCIL OF THE RELIGION OF ISLAM AND MALAY CUSTOM, KELANTAN (AMENDMENT) ENACTMENT 1998

Section 2. Amendment of section 39.

The Council of the Religion of Islam and Malay Custom, Kelantan, Enactment 1994 [En. No. 4/94] is amended by substituting for section 39 the following:

"Publication of fatwa.

39. (1) Where a fatwa issued by the Majlis or the Jamaah Ulama' is to be published in the Gazette , the Majlis shall, before the fatwa is so published, present a copy of the fatwa to His Royal Highness the Sultan for His Royal Highness's assent.

(2) When a fatwa has been assented to by His Royal Highness the Sultan, the Majlis shall, if so ordered by His Royal Highness, cause the fatwa to be published in the Gazette.

(3) Any statement made by the Jamaah Ulama' or the Majlis shall not be taken to be a fatwa unless such statement is published in the Gazette in accordance with subsection (2).".
