ISLAMIC FAMILY LAW (AMENDMENT) ENACTMENT 1984

Section 9. Amendment of First Schedule.

The First Schedule to the principal Enactment is amended as follows:

(i) by substituting paragraph 13 of Form 3E the following:

"13. The bride is an anak dara/janda/balu, completed the edah period by three Quru'/ three months/delivery/four months ten days and the last husband does not rujuk her and there are no disqualifications for her marriage and he certificate of Divorce No ............................./certificate of death No. .................... issued by .............................. ".

(ii) by substituting paragraph 21 of Form 3E the following:

"21. Declaration of Taliq-I ................................. hereby made the declaration of Taliq that whenever I leave my wife ....................................... for four months or more willfully or under duress or I or my representative do not give her compulsory maintenance for such period, whereas she is faithful to me or I cause hurt to her body or I neglect her for four months or more, or .............................. later make a complaint to the Qadhi/Hakim Syarak which if found to be true and she gave to the Qadhi/Hakim Syarak on my behalf an amount of $1.00 then immediately she is divorced by a talak khulie.

(iii) by substituting for a Sighah Taliq in Form 3F by the following:

"SIGHAH TALIQ

I .................................................. hereby make the declaration of Taliq that whenever I leave my wife for four months or more willfully or under duress or I or my representative do not give her compulsory maintenance for such period whereas she is faithful to me or cause hurt to her body or I neglect her for four months or more, or .......................................... later make a complaint to the Qadhi/Hakim Syarak which if found to be true and she gave to the Qadhi/Hakim Syarak on my behalf an amount of $1.00 then immediately she is divorced by a talak khulie".

(iv) by inserting immediately after Form 3G as follow-
