ENACTMENT NO. 3 OF 1996 ISLAMIC FAMILY LAW (AMENDMENT) ENACTMENT 1996
Section 3. Amendment of section 2
Section 2 of the principal Enactment is amended---
(a) by inserting before the definition "anak dara" the following new definition:
' "Administration Enactment" means the Administration of Islamic Law Enactment 1992;';
(b) in the bahasa kebangsaan text, by substituting for the definition "bermastautin" the following definition:
' "bermastautin" ertinya tinggal secara tetap atau pada kelazimannya, tinggal berumahtangga dalam sesuatu kawasan yang tertentu;';
(c) by substituting for the definition "Court" the following definition:
' " Court" means the Syariah Subordinate Court or the Syariah High Court constituted under section 40 of the Administration Enactment;';
(d) by substituting for the definition "harta sepencarian" the following definition:
' " harta sepencarian" means the earnings or the property acquired as a result of joint effort of husband and wife and includes any income derived from capital which is itself the result of joint effort or any other form of contribution during the marriage;';
(e) by substituting for the definition "janda" the following definition:
' "janda" means a woman who had been divorced;';
(f) by substituting for the definition "kariah" and "kariah masjid" the following definition:
' " kariah" or "kariah masjid" in relation to mosque, means the area or boundary determined under section 63 of the Administration Enactment;';
(g) by substituting for the definition "Majlis" the following definition:
' "Majlis" means the Majlis Agama Islam dan 'Adat Melayu Perak established under section 4(1) of the Administration Enactment;';
(h) in the definition "mas kahwin" by deleting the word "marriage" after the word "obligatory";
(i) in the definition "mut'ah" of the national language text by substituting for the words "dari segi" the word "mengikut";
(j) by substituting for the definition "Syar'iah Judge" the following definition:
' " Judge" means the Syariah Subordinate Court Judge or the Syariah High Court Judge;';
(k) in the definition "syubahah intercourse" by substituting for the word "Had" the following "Had";
(l) by substituting for the definition 'temporary residence (bermukim)" the following definition:
' " temporarily reside" means temporarily residing in a particular place;'.
