Section 3. New sections 29A, 29B, 29C.


The principal Enactment is amended by inserting after section 29, the following sections -

"Appointment of Chief Syariah Enforcement Officer and Syariah Enforcement Officers.

Power to require attendance
of witnesses.











Examination of witnesses.
29A. The Majlis may appoint the Pengarah Jabatan hal ehwal Agama Islam Perlis as the Chief Syariah Enforcement Officer and such other officers from the Jabatan Hal Ehwal Agama Islam Perlis as Syariah Enforcement Officers to carry out investigation under this Enactment.

29B. A Syariah Enforcement Officer making an investigation under this Enactment, may by order in writing require the attendance before himself of any person who appears to him to be acquainted with the circumstances of the case, and such person shall attend as so required:

Provided that no person shall be required under this section to perform a journey of more than seven miles from his usual place of abode exclusive of such portion of the journey as may be performed by train or motor car or other vehicle.

(2) If any person subject to an order under sub-section (1) fails to attend as required by the order, tha Syariah Enforcement Officer may report the failure to a Kadi who may thereupon issue a warrant to secure the attendance of the person as required by the order.

29C (1) A Syariah Enforcement Officer making an investigation under this Enactment, may examine orally any person supposed to be acquainted with the facts and circumstances of the case and shall reduce into writing any statement made by the person so examined.

(2) Such person shall be bound to answer all questions relating to such case put to him by the Syariah Enforcement Officer:

Provided that such person may refuse to answer any question the answer to which would have tendency to expose him to a criminal charge or penalty or forfeiture.

(3) A person making a statement under this section shall be legally bound to state the truth, whether or not such statement is made wholly or partly in answer to questions.

(4) A Syariah Enforcement Officer examining a person under sub-section (1) shall first inform that person of the provisions of sub-section (2) and (3).

(5) A statement made by any person under this section, shall whenever possible, be reduced into writing and, after it has been read to the person in the language in which he made it and he has been given an opportunity to make any corrections he may wish, shall be signed by him or affixed with his thumbprint".
