ADMINISTRATION OF THE SYARIAH COURT (AMENDMENT) ENACTMENT 1991



Section 5. A new section 7A.


The principle Enactment is hereby amended by inserting a new section 7A as follows:

"Section 7A. Tenure of office.

(1) Subject to the provisions mention in this section, a Judge appointed under section 6 shall hold office until he attains the age sixty five.

(2) A Judge may at any time resign his office by writing under his hand addressed to the Yang di-Pertuan Agong but shall not be removed from office except in accordance with the following provisions.

(3) If The Chairman of Majlis represents to the Yang di-Pertuan Agong that a Judge ought to be removed on the ground of-
Yang di-Pertuan Agong shall refer the representation to a committe to be appointed in accordance with subsection (4), and may on the recommendation of the committe remove the Judge from office.

(4) The said committe shall consist the following members:

The committe shall be presided by the State Legal Adviser.

(5) Pending any reference and report under subsection (3), the Yang di-Pertuan Agong may on the recommendation of Chairman of Majlis, suspend the Judge from the exercise of his functions.

(6) Notwithstanding subsection (1), the validity of anything done by a Judge shall not be questioned on the ground that he has attained the age at which he was required to retire.

(7) The provisions of this section shall apply to all Judges appointed under section 7."
