Section 5. Amendment of section 36.

Section 36 of the principal Enactment is amended by Amendment substituting with the following:

"Section 36. Rulings (Fatwa).

(1) The Mufti shall on the instruction of the Yang di-Pertuan Agong, and may, on his own motion or on request in writing by any person addressed to the Secretary, issue a fatwa on any matter relating to Islamic Law.

(2) Any fatwa issued under this section, shall be published by notification in the Gazette and thereupon shall he binding on all Muslim resident in the State.

(3) No statement made by the Mufti shall be deemed to be a fatwa until and unless published in the Gazette.

(4) The Mufti may amend, vary or repeal any fan-va which had been earlier on issued either by him or by any of his predecessors. Such amendment, variation or repeal shall be published by notification in the Gazette and thereupon shall be binding on all Muslim in the State.".
