ENACTMENT NO. 4 OF 1992 ISLAMIC FAMILY LAW (AMENDMENT) ENACTMENT 1992
Section 13. Amendment to section 49A.
The principal Enactment is amended by inserting immediately after section 49, a new section 49A as follows:
"Divorce on presumption of death. 49A. (1) If a husband is believed to have died or has not been heard of for a period of four years or more and the circumstanced are such that according to Hukum Syara' he ought to be presumed to have died, for the purpose of enabling his wife to remarry, the Court may on her application and after due investigation issue in a prescribed form a certificate presuming that he is dead.
(2) A certificate issued under subsection (1) shall be registered as if it effected a divorce.
(3) If she remarries and later the husband who has presumed dead returns or is found or proved to be still alive then her remarriahe shall be null and void, and shall return to her former husband after the expiry of the period of 'iddah.".
