Section 60. Marriage of Janda.

(1) Subject to subsection (3), where the woman to be married is a janda, she shall not be married to a person other than the husband from whom she was last divorced before the expiration of the period of iddah.

(2) The janda shall not be married unless she shall first produce-

(a) a certificate of the death of her late husband; or

(b) a certificate of divorce lawfully issued under the law for the time being in force or a copy of a document certifying the evidence of divorce from the register of divorce; or

(c) a certificate granted by the Court of a Kadi having jurisdiction in the place where she resides, to the effect that she is a janda.

(3) If the divorce of the janda was by three talaq, she shall not be married to her previous husband unless she has been lawfully married to some other male person and such marriage having been consumated and later lawfully dissolved.
