PART II - GENERAL PROVISIONS AS TO CRIMINAL COURTS CHAPTER IV - SUMMONS Other Rules Regarding Summonses to Appear and Warrants of Arrest
Section 37. Issues of warrant in lieu of or in addition to summons.
A Court or a Judge may, in any case in which it or he is empowered to issue a summons for the appearance of any person, issue a warrant for his arrest-
(a)if, either before the issue of summons or after the issue of the same but before the time fixed for his apearance, the Court or Judge has reason to believe that he has absconded or will not obey the summons; or
(b) if at specified time and place he fails to appear and the summons is proved to have been duly served in time to admit of his appearing in accordance therewith and no reasonable excuse is offered for such failure,
and the Court or Judge shall record the reason for issuing the warrant of arrest.
