Section 39. Authorities to be followed.
(1) In making and issuing any fatwa in the manner hereinbefore provided the Majlis and the Syariah committee shall ordinarily follow the orthodox tenets of Mazhab Syafii :
Provided that, if it is considered that the orthodox tenets or the less orthodox tenets of Mazhab Syafii will be opposed to the public interest, the Majlis may, with the special sanction of His Royal Highness the Sultan, follow the tenets of any of the other Mazhabs (Maliki, Hanafi and Hambali) as may be considered proper but any fatwa made in this manner shall be clearly set out with the necessary explanation.
(2) Any fatwa given by the Majlis whether directly or through the Syariah Committee or any determination of any question by His Royal Highness the Sultan in accordance with the foregoing provision shall, if His Royal Highness so directs, be published by
notification in the Gazette and shall thereupon be binding on all Muslims resident in the State.
