PART IX - OFFENCES



Section 148. Illicit intercouse between divorced person.

(1) Any male Muslim who, having lawfully divorced his wife, resumes cohabitation with her without having pronounced a lawful rujuk shall be guilty of an offence and shall on conviction be liable to a fine not exceeding five hundred ringgit or imprisonment for a term not exceeding six months or to both.

(2) If his wife was not at the time of such resumption of cohabitation aware of the accurence of the divorced he shall be liable to a fine not exceeding one thousand ringgit or imprisonment for a term not exceeding on year or to both.

(3) Any female person being the other party in the commission of the offence under subsection (1) and having knowledge of the divorce shall be guilty of an offence and shall on conviction be liable to a fine not exceeding five hundred ringgit or to imprisonment for a term not exceeding six months or to both.
