JUMA'AH ULAMA



Section 14. Authorities to be followed.

(1) In making and issuing any ruling in manner hereinbefore provided the Majlis and the Jumaah Ulama shall ordinarily follow the orthodox tenets of the Shafeite sect;

Provided that, if it is considered that the following of such orthodox tenets will be opposed to the public interest, the Majlis or the Jumaah Ulama may, with the appoval of His Highness the Sultan, follow the less orthodox tenets of the Shafeite sect;

Provided further that if it is considered that the following of the less orthodox tenets of the Shafeite sect will still be opposed to the public interest, the Majlis or the Jumaah Ulama may, with the special sanction of His Highness the Sultan follow any of the remaining three sects of Islam (Maliki, Hanafi, Hambali);

Provided further that, if it is considered that the following of the tenets of the three sects (Maliki, Hanafi and Hambali) will still be opposed to the public interest, the Majlis or the Jumaah Ulama may, with the special sanction of His Highness the Sultan, follow the tenets of other sects of Islam (mu'tabar) which are acceptable to the Teaching of Islam except in matters pertaining to belief or faith in God and Prophets (i'tikad) the tenets of Al-Sunnah Wal Jumaah will be followed.

(2) In making and issuing any ruling in accordance with the provisions of this section, the Majlis shall have due regard to the Adat Istiadat Melayu or Malay Customs applicable in the State, which are not contrary to the Teaching of Islam.

(3) Any ruling given by the Majlis, whether directly or through the Jumaah Ulama, in accordance with the foregoing provisions shall, if the Majlis so determines or if His Highness the Sultan so directs, be published by notification in the Gazette and shall thereupon be binding on all Muslims resident in the State, other than Muslims not being of Malay race, who are subject to a personal law other than that obtaining in Kelantan.
