SYARIAH CIVIL PROCEDURE ENACTMENT 1993

PART I – PRELIMINARY



Section 2. Interpretation.

(1) In this Enactment, unless the context otherwise requires -

"action" includes "suit" and vice-versa;

"bailiff" includes Registrar or other officer of the Court charged with performing the duties of a bailiff;

"certified translation" means a translation certified as correct by the officer of the Court;

"Chief Syarie Judge" has the same meaning as assigned thereto in the Syariah Courts Enactment 1992;

"Courts" has the same meaning as assigned Syariah Courts Enactment 1992;

"garnishee" means a third party who is having the possession or control of judgment a debtor's property;

"Judge" means a Syarie Judge or a Syariah Lower Court Judge, as the case may be, appointed under the Syariah Courts Enactment 1992;

"lien" means a right on the property of a judgment debtor to the extent of the indebtedness;

"Majlis" means the Majlis Ugama Islam Sabah establishment under section 4 of the Administration of Islamic Law Enactment 1992;

"minor" means a person who has not attained the age of 18 years;

"notice" means written notice unless the Court in any case shall order otherwise;

"Peguam Syarie" has the same meaning as assigned thereto in the Syariah Courts Enactment 1993;

"person under disability" includes minor, person of unsound mind and person prohibited from administering property;

"prima facie" means a fact presumed to be true unless disproved by some evidence to the contrary;

"Registrar" means the Chief Registrar of the Syariah Appeal Court, the Registrar of the Syariah High Court or the Assistant Registrar of the Syariah Lower Court appointed under the Syariah Courts Enactment 1992;

"Syariah Lower Court Judge" has the same meaning as assigned thereto in the Syariah Courts Enactment 1992.

(2) All words, expressions, definitions and terms used in this Enactment and not specially defined shall be deemed to have the meanings given to them in the Interpretation and General Clauses nactment, 1963.
