PART II - MAJLIS CONSTITUTION JUMA'AH ULAMA
Section 13. Ruling (Fetua)
(1) Any person may, by letter addressed to the Secretary request the Majlis to issue a ruling (Fetua) on any question relating to Hukum Shara' or Malay Custom. On receiving any such request the Secretary shall forthwith submit the same to the Chairman of the Jumaah Ulama.
(2) The Jumaah Ulama shall consider every such request and shall, unless in its opinion the question referred to is frivolous or for other good reason ought not to be answered, prepare a draft ruling thereon, and if such draft ruling is apporoved either unanimously or by a majority which shall not be less than two-third of the members appointed under sub-section (1) of section 12, the Chairman on behalf of and in the name of the Majlis shall forthwith issue a ruling in accordance thereof. If no such ruling can be issued in accordance with the provisions above the Jumaah Ulama shall refer to the Majlis which shall issue its ruling basing upon the recommendations and guidance given by the Mufti, provided that on special ground any such question may be referred by the Majlis to His Highness the Sultan for his determination, and any such question shall be referred to His Highness the Sultan if the Mufti so requests.
