Section 41. Caution and discharge.

(1) The Court may, without proceeding to record a conviction against any person found guilty of an offence, caution and discharge such person and may, where a conviction is recorded, order him to be bound over on a bond in any sum (with or without sureties), to be of good behaviour for a period not exceeding one year.

(2) The Court may if it is satisfied that there is a breach of the terms of any said bond order such bond to be forfeited as if the amount due thereon were a fine.

(3) Any person aggrieved by an order under sub-section (2) may appeal.
