Section 53. Withdrawal and settlement.

(1) The plaintiff may withdraw any proceedings at any time before judgment.

(2) A plaintiff withdrawing aforesaid shall be liable to pay the costs of the proceedings so withdrawn and shall not without the leave of the Court thereafter bring any other proceedings on the same cause of action.

(3) The parties to any proceedings may compromise and settle the same at any time, and the Court shall, if so requested by any of the parties, record the terms of any such settlement:

Provided that no such compromise or settlement shall be made by the personal representative of a deceased person's estate or by a representative appointed under sub-section (2) of section 50 of this Enactment without the leave of the Court, and the Court shall in respect of such compromise or settlement have due regard to the interest of the beneficiaries or the persons represented.
