CRIMES (SYARIAH) ENACTMENT 1992
PART VI - OFFENCES RELATING TO DECENCY
| (1) A woman who is pregnant or who gives birth to a child out of wedlock as a result of illicit intercourse performed with her consent and awareness, is guilty of an offence and shall, on conviction, be liable to a fine not exceeding three thousand ringgit or to imprisonment for a term not exceeding two years or to both. (2) A woman who gives birth to a fully developed child within a period of six months after her marriage shall be deemed to have been pregnant out of wedlock: Provided that the burden lies on the woman to prove that she had syubhah intercourse as such or was married or that the child was delivered within a period which is acceptable to Hukum Syara'. |
