PART III - THE APPOINTMENT OF THE MUFTI, AUTHORITY IN RELIGIOUS MATTERS, THE FATWA COMMITTEE AND FATWA RELATING TO MATTER OF NATIONAL INTEREST

Section 35. Fatwa Committee.

(1) There shall be a committee known as the Fatwa Committee.

(2) The Committee shall consist of --

(a)

the

Mufti

, as Chairman;

(b)

the Deputy

Mufti

;

(c)

two members of the Majlis who are learned in

Hukum Syarak

nominated by the Majlis;

(d)

a fit and proper officer from the Islamic Religious Department of Perak nominated by the Director of that Department;

(e)

not less than two and not more than five fit and proper persons who are learned in

Hukum Syarak

to be appointed by the Majlis; and

(f)

an officer from the Mufti's Department appointed by the Majlis, who shall be the Secretary.

(3) Any person who, immediately before the commencement of this section, was a member of the Syariah Committee established under the previous Enactment shall, subject to subsection (4), be deemed to have been nominated or appointed as a member of the Fatwa Committee and shall be a member of the Fatwa Committee until the expiry of his term of appointment under the previous Enactment.

(4) Subsection (3) shall not apply to any person, except the Mufti, who was an ex-officio member of the Syariah Committee mentioned in subsection (3).

(5) The Fatwa Committee may, subject to this Enactment, determined all questions relating to its procedure and practice.
