PART III - CONSTITUTION OF SYARIAH COURTS APPOINTMENT OF OFFICERS AND THEIR JURISDICTION



Section 44. Court of Appeal.

(1) The Majlis, with the approval of His Royal Highness the Sultan, shall appoint annually not more than seven Muslims who are thought fit and proper to constitute a standing panel of judges and the Yang di-Pertua shall select three from among them to from a corum of judges in the Court of Appeal in respect of every hearing and shall appoint one of them to be the Chairman.

(2) The names of the seven members shall be published in the Gazette.

(3) Appeals to the Court of Appeal may be filed by any party who is aggrieved by the judgment, direction, order or decision of the Court of a Kadi or the Kadi Besar in accordance with the provisions hereinafter provided.

(4) Appeals to the Court of Appeal may be made direct from the Court of a Kadi or the Kadi Besar.
