PART VIII - MARRIAGE AND DIVORCE
Section 85. Form to be filled and inquiry to be made before solemnisation as to legality and consent.
(1) A person appointed under section 82 shall not solemnise a marriage unless-
(a)The person to be wedded has filled up and signed and delivered to him a prescribed Form not less than 10 (ten) days from the date when the marriage is to be solemnised, unless for some good cause the marriage (has to be immediately solemnised.
(b)After full inquiry he is satisfied that the marriage would be legal under Muslim Law and that the Wali of the woman to be married has consented to the marrIage.
(2) The person appointed under section 82 aforesaid may require any Muslim to appear before him to give evidence or produce any document for the purpose of the inquiry under sub-section (1) of this section.
(3) Where a woman to be wedded has no wali or where the wali of such woman unreasonably withholds his consent to the marriage, the consent may be obtained from the WaIi Raja.
