PART VIII - MARRIAGE AND DIVORCE
Section 91. Application for divorce by the wife.
(1) A married woman may apply to a Kathi for a divorce, and the Kathi shall thereupon cause notice of such application for a divorce to be served-
(a) upon the husband of the woman in question;
(b)upon the nearest relative of the said husband, in any case where an affidavit is made by the woman in question that her husband is not within the State or that it is impossible to serve the notice on the said husband; or
(c) by substituted service in accordance with the procedure of the Subordinate Courts Rules.
(2) If the husband does not appear at the hearing, service of the notice under sub-section (1) shall be proved by the woman in question and by two other witnesses and the Kathi shall if he is satisfied that the notice has been served make such order or decree as is lawful.
(3) On an application made by the wife for permission to divorce her husband the Kathi shall for the purpose of effecting a peaceful reconciliation made such enquiries with respect to the said applicant and her husband as the Kathi thinks fit and the Kathi shall not grant any permission for divorce unless he is convinced that no reconciliation is practicable.
(4) The Kathi shall in a hearing of an application for a divorce by a woman under this section record all the evidence adduced in respect of such case at that hearing.
