PART VIII - MARRIAGE AND DIVORCE



Section 87. Place and registration of marriage.

(1) Every marriage shall be solemnised in the kariah masjid in which the woman to be married ordinarily resides:

Provided that a Registrar having jurisdiction in such kariah may give permission in writing for any such marriage to be solemnised elsewhere.

(2) Every marriage shall be registered and the fees in respect thereof shall be paid in the place where the marriage is solemnised.

(3) In relation to a marriage solemnised by a person other than a person appointed under section 82 the person so solemnising the marriage shall within seven days of the date of the marriage report the solemnisation thereof to the Registrar within whose kariah such marriage was solemnised, and the Registrar shall on receipt of the particulars of such marriage and on payment of the prescribed registration fees enter in a register kept by him for that purpose such particulars as may be prescribed.

(4) The Registrar shall in respect of every marriage to be registered by him ascertain and record-
(5) The Registrar shall before registering any marriage make enquiry to satisfy himself that all requirements of Muslim Law and of the Enactment have been complied with find that the said marriage was valid and registrable.

(6) A Registrar shall have power to administer oaths and affirmation and may examine any person on oath or affirmations concerning any matter submitted to him for registration.

(7) Upon registering any marriage the Registrar shall issue to each of the parties to the marriage a marriage certificate in the prescribed form.

(8) The person solemnising the marriage shall deliver to the Registrar and to each of the parties to the marriage a surat ta'alik, in the prescribed form, duly signed by himself and by the said parties.
