PART III – PARTIES



Section 17. Minor plaintiff attaining majority.

(1) A minor plaintiff on attaining majority during the pendency of the proceeding, may either withdraw the same before taking any step therein or adopt the same.

(2) No leave to withdraw shall be required, but the provision of Part XIV shall apply as regards the matter.

(3) If the plaintiff withdraws as aforesaid, he shall not be personally liable for costs, unless the Court shall so order.

(4) If here are more than one plaintiff, the former minor plaintiff shall not be entitled top withdraw without leave, but may apply to the Court to dismiss him from the action and the Court may do so, or if he is a necessary party, may strike him out as plaintiff and add him as defendant, on such terms as the Court may fix.

(5) If the proceeding is continued the plaintiff shall apply to amend the title of the proceeding andthe court may amend the title and release the guardian.
