PART III - MARRIAGE AND DIVORCE

Section 59. Appointment of Registrars.

(1) His Highness the Sultan may appoint any fit and proper persons to be Registrars of Muslim Marriages and Divorces in any place.

(2) The Kadhi Besar and every Kadhi shall be ex-officio Registrars of Muslim Marriages and Divorces for the whole of the areas in which they respectively have jurisdiction in criminal and civil matters.

(3) The Imam Tua of every mosque shall be ex-officio a Registrar of Muslim Marriages and Divorces for the mukim of his mosque.

(4) Registrars of Muslim Marriages and Divorces shall have such rights and powers and perform such duties as may be conferred or imposed upon them by this Enactment or any rules made thereunder.

(5) Registrars of Muslim Marriages and Divorces shall be deemed to be public servants within the meaning of the Penal Code.
