PART IX - OFFENCES
Section 146. Adultery.
(1) Any male Muslim who has sexual intercourse with a woman and knows or has reason to believe that the woman is the wife of another man and no charge is preferred against him in a Civil Court for the offence of rape under the Penal Code or such act of sexual intercourse does not constitute an offence of rape under the Penal Code shall be guilty of an offence of adultery and shall on conviction be liable to a fine not exceeding one thousand ringgit or imprisonment for a term not exceeding six months or to both.
(2) Any female Muslim being the other party in the commission of the offence subsection (1) shall be guilty of an offence and shall on conviction be liable to the same punishment as provided for under subsection (1).
(3) Any Muslim who abets the commission of any offence under this section shall be liable to the same punishment as provided for under subsection (1).
