PART II - MAJLIS



Section 8. Shara'iah Committee.

(1) There shall be established, for the purpose of advising the Majlis on any matter relating to a Fetua to be issued pursuant to the foregoing provisions, a Shara'iah Committee, consisting of-

(2) The persons specified in paragraphs (b) and (c) of sub-section (1) shall be appointed by the Ruler by notification in the Gazette, and such appointments shall unless sooner resigned or revoked be for the period specified in the instruments appointing them to be members of the Shara'iah Committee.

(3) The Mufti shall be the Chairman of the Shara'iah Committee and, in the absence of the Chairman, the Ruler shall, appoint one of the members of the said Committee to preside at meetings of the Committee.

(4) The Chairman or, in his absence, the person appointed to preside, and two other members shall form a quorum.

(5) The Shara'iah Committee shall determine its own procedure.

(6) The provisions of the First Schedule relating to disqualification of members of the Majlis shall have effect with respect to the Shara'iah Committee as if for the word "Majlis" there were substituted the words "Shara'iah Committee".

(7) The members of the Shara'iah Committee shall be deemed to be public servants for the purposes of the Penal Code.
