ENACTMENT NO. 5 OF 1992 ADMINISTRATION OF THE SYARIAH COURT ENACTMENT 1991
PART III - JURISDICTION OF SYARIAH COURT
Section 15. Powers of Appeal Committee.
On any appeal the Appeal Committee may -
(a) in a criminal matter -
(i) confirm or quash the conviction,
(ii) set aside, reduce, confirm or enhance the sentence,
(iii) dismiss the appeal,
(iv) order a retrial before the same Kadi or some other Kadi,
(v) convict the accused and sentence him according to law,
(vi) alter the conviction from one offence to another offence as provided for by a State Islamic Law.
(b) in a civil matter -
(i) confirm, reverse or vary the judgment, order or decision of the trial court,
(ii) exercise any such powers as the trial court could have exercised,
(iii) make any order which can be made by the trial court,
(iv) order a retrial either before the same Kadi or some other Kadi.
(2) No appeal shall be allowed or retrail ordered on grounds of irregularity of procedure or wrongful admission or exclusion of evidence, unless such irregularity of procedure or wrong admission or exclusion of evidence has occassioned a failure of justice.
