Section 46. Procedure not provided for.
As respects practice and procedure in criminal proceedings not expressly provided for in this Enactment or in any rules made thereunder, the Court shall have regard to the avoidance of injustice and the convenient despatch of business and may have regard to the practice and procedure obtaining in the Magistrate's Courts in Criminal proceedings.
