PART III - CONSTITUTION OF SYARIAH COURTS APPOINTMENT OF OFFICERS AND THEIR JURISDICTION

Section 40. Appointment of Kadi Besar and other officers and the authority to confer Tauliah to them.

(1) The State Public Services Commission may, on the recommendation of the Majlis, appoint officers referred to in subsection (2) and other employees required to carry out the purposes of this Enactment.

(2) The appointment of the following officers shall not take effect without the approval of His Royal Highness the Sultan by being conferred with a Tauliah by him-

(a) Kadi Besar,

(b) Kadi,

(d) Religious Inspector,

(e) Religious Teachers,

(f) Religious Information Officers, and

(g) Pegawai Masjid.

The appointment of officers in paragraphs (a) to (d) shall be published in the Gazette.

(3) If, for any reason officers referred to in subsection (2) shall cease to be in office, they shall surrender their Tauliah to the office of His Royal Highness the Sultan and if they fail to surrender them, the Tauliah shall be deemed to have been cancelled on the date when they cease to hold office.
