MUFTI AND FATWA (KEDAH DARUL AMAN) ENACTMENT 2008

PART I - PRELIMINARY



Section 2. Interpretation

(1) In this Enactment, unless the context otherwise requires-

“Fatwa Committee Member” means the member appointed by the Royal Highness Sultan under section 11;

“previous Enactment” means the Administration of Muslim Law Enactment Kedah 1962 [Enactment No. 9 of 1962];

“fatwa” means the fatwa issued under section 8 or 19;

“Hukum Syarak” means Hukum Syarak according to Mazhab Syafie or any one of the Mazhab Hanafi, Maliki or Hambali;

“Department” means the Department of Mufti of the State of Kedah Darul Aman;

Fatwa Committee” means Fatwa Committee established under section 10;

Majlis” means the Majlis Agama Islam Negeri Kedah established under the Administration of Muslim Law 1962 [Enactment No. 9 of 1962];

“Mufti” means the officer appointed by His Royal Highness the Sultan under section 5;

“nas” means evidence or argument being brought to support any decided hukum;

“State” means the State of Kedah Darul Aman;

“Research Officer” means the Research Officer and the Assistant Research Officer of the Department of Mufti of the State of Kedah Darul Aman;

“Chairman” means the Chairman of Fatwa Committee;

“qaul muktamad” means firm or strong belief based on any one Mazhab;

“remuneration” means basic salary, allowance, incentive, honorarium, free or subsidized transportation and other privileges that can be valued with money;

“Secretary” means secretary to the Fatwa Committee appointed under section 13;

“Deputy Mufti” means the Deputy Mufti appointed under section 5.

(2) All words and expressions used in this Enactment and not herein defined in this Enactment but defined in Interpretation Act 1948 and 1967 [Act 388] shall have the meaning thereby assigned to them respectively to the extend that such meanings do not conflict with Hukum Syarak.

(3) For the avoidance of doubt as to the identity or interpretation of the words and expression used in this Enactment that are listed in the First Schedule, reference may be made to the Arabic script for those words and expressions as shown against them therein.
