PART II - CONSTITUTION OF MAJLIS Mufti and Syariah Committee
Section 38. Fatwa.
(1) Any person may by letter addressed to the Yang di-Pertua request the Majlis to issue a fatwa on any matter relating to the Religion of Islam or nas.
(2) The Yang di-Pertua shall refer such request to the Chairman of the Syariah Committee and the Chairman shall consider every such request and shall, unless in his opinion the matter refered to is frivolous or for other good reason ought not to be answered, prepare a draft fatwa. He shall then call a meetmg of the Syariah Committee to consider and to give a ruling on the draft fatwa that he has prepared. If any ruling is supported by nas, the Mufti shall forthwith issue the fatwa. If in any such case the Syariah Committee is not unanimous the question shall be referred to the Majlis and the Majlis shall, in like manner, issue its ruling in accordance with the opinion of the majority of its members present:
Provided that on special grounds any such question may be referred by the Majlis to His Royal Highness the Sultan for his determination.
(3) The Majlis may at any time of its own motion publish any fatwa or resolution made by the Syariah Committee.
(4) If in any Court including Civil Courts other than the court of Kadi Besar or the court of a Kadi any question relating to Hukum Syara' or the Malay Custom of Pahang requires to be decided, and such court requests the opinion of the Majlis on such
question, the question sha11 be referred to the Majlis and the Majlis shall give its opinion.
