Search Warrants

Section 43. When search warrant may be issued.

(1) Where -

(a) any Court has reason to believe that a person to whom a summons under section 41 has been or might have been addressed will not or would not produce the property or document required;

(b) any property or document required under section 41 is not known to the Court to be in possession of any person;

(c) the Court considers that for the purposes of any inquiry, trial or other proceeding under this Enactmentjustice will be served by a general search or inspection; or

(d) a Judge, having been satisfied on a written information givenj to him by way of declaration and after making such inquiry as he thinks necessary, has reason to believe that an offence has been committed in any place,

the Court may issue a serach warrant and the person to whom the warrant is directed may search and inspect in accordance therewith and with the provisions of this Enactment.

(2) A search warrant shall ordinarily be directed to a Religious Enforcement Officer or to some other officer to be designated by name or office therein and such police officer may execute such warrant.

(3) The Court issuing a search warrant may direct it to the Inspector General of Police or to some other police officer to be designated by name or office therein and such police officer may execute such warrant.
