Section 36. Fatwa.

(1) The Mufti may on his own initiative or on the request of any person made by letter addressed to the Mufti, or on the direction of His Royal Highness the Sultan, make and, subject to subsection (2), publish in the Gazette a fatwa or opinion on any unsettled or controversial question in respect of or relating to Hukum Syarak.

(2) A fatwa made by the Mufti may be published in the Gazette if he considers it necessary but shall be published in the Gazette if His Royal Highness the Sultan orders so.

(3) Upon being made by the Mufti, a fatwa shall be binding upon every Muslim residing in the State of Pahang as a dictate of his religion and it shall be his religious duty to abide by and uphold the fatwa, unless he is permitted by Hukum Syarak to depart from the fatwa in matters of personal observance, belief or opinion.

(4) A fatwa shall be recognized by all Syariah Courts in the State of Pahang as authoritative on all matters laid down therein.
