PART VI - OFFENCES
Section 60. Attendance at Mosque.
Any male of the age of fifteen years or over who fails to attend prayers on Friday without written permission from the Imam Tua, or Kadzi of the district concerned to the effect he may be execused from attending such prayers at a mosque in accordance with the provisions of section 54 of this Enactment shall, subject as hereinafter provided, be liable to a fine not exceeding $25 or with imprisonment not exceeding a week or both, or if he is absent from attending such prayers for three successive Fridays, he shall be liable to a fine not less than $100 and not exceeding $250 or to an imprisonment not exceeding three months or both such fine and imprisonment.
Provided that no offence shall be committed by any such person if -
(a) his attendance is prevented by rain, or
(b) his place of residence is more than three miles by the nearest route from a mosque, or
(c) less than forty male Muslims aged fifteen years or over, or such lesser number as His Highness the Sultan may prescribe as the number in whose presence Friday prayers may be performed, reside in the mukim in which he then is, or
(d) he has been excused attendance by any pegawai masjid of the mukim in which he ordinarily resides or then is, on grounds of sickness or absence from his ordinary place of residence.
