(1) If in the course of any proceedings relating to the administration or distribution of the estate of the deceased Muslim, any Civil Court or authority, other than the Syariah High Court or a Syariah Subordinate Court, is under a duty to determine-
(a) the persons entitled to share in the estate; or
(b) the shares in the estate, or the shares to which such persons are respectively entitled.
(2) The Syariah Court may, on the application of any person who claims to be a beneficiary or his representative, and on payment of the prescribed fee, certify the facts found by it and its opinion as to the persons who are entitled to share or as to the shares to which they are respectively entitled.
