PART IV - GENERAL PROCEDURE

Section 24. Peguam Syarie.

(1) The Majlis may permit any Muslim who is suitable and competent upon his application to be a Peguam Syarie.

(2) For the purpose of sub-section (1), any of the following persons are deemed to be suitable and competent in matters pertaining to the Hukum Syarak -

(a) the holder of a degree in Islamic Law from any centre of higher learning that is recognised by the government of Malaysia;

(b) a person who in the opinion of the Majlis possesses competence and qualification in Hukum Syarak.

(3) A Peguam Syarie shall not appear and act as a representative of any party in any court except with a certificate in writing issued by the Majlis and on payment of the prescribed fees. Such certificate shall be isued for a period of two yeras and shall be signed by the President of the Majlis.

(4) The Ruler or any person authorised by the Ruler, may in writing appoint any suitable person to be an advocate to defend or plead on behalf of a poor person in any proceeding and in such event the court fees normally payable in respect of such proceeding shall not be payable by such person and shall be exempted.
