CHAPTER 9 - TO ENSURE THE EVIDENCE OF THE WITNESSES ARE TRUE



Section 126. Denial (ta'in) over a witness.

When the defendant or the accused has made a denial (ta'in) over a witness either before or after an examination of the witness by producing anything which can prevent the admissibility of evidence, the Judge shall request him to give evidence.

Explanation - Whenever defendant or an accused proves what he states with evidence, a Judge shall reject the evidence of that witness. However if the defendant or an accused fails to rebut what was stated, the Judge shall proceed with the examination of the witness if he has not done so and give his decision according to the evidence if he has conducted the examination.
