PART III - APPOINTMENT OF JUDGES AND JURISDICTION OF SYARIAH COURTS
Section 6. Appointment of Chief Syarie Judge.
(1) The Duli Yang Maha Mulia Sultan, on the advice of the Menteri Besar, may appoint a Chief Syarie Judge.
(2) A person is qualified for appointment under subsection (1) if-
(a) he is a citizen who is a Muslim; and
(b) he-
(i) has for a period of not less than ten years before his appointment, been a Judge of the Syariah High Court or a Syariah Subordinate Court or a Qadi or a Registrar or a Syarie Prosecutor of a State or sometimes one and sometimes another;
(ii) has for a period of not less than fifteen years before his appointment been a Peguam Syarie of a State or at any time before that in any State; or
(iii) is a person learned in Hukum Syarak.
(3) The person who, immediately before the commencement of this section, was holding the post of Chief Syarie Judge under the previous Enactment and was performing judicial functions shall, on the commencement of this section, continue to hold office as the Chief Syarie Judge as if he had been appointed under subsection (1).
(4) The appointment under subsection (1) shall be published in the Gazette.
