PART X - PROCEDURE IN CRIMINAL PROEEDINGS



Section 195. By whom and how warrant of arrest is effected.

(1) A warrant of arrest shall ordinarily be directed to the Inspector-General of Police or any police officer in West Malaysia and any police officer may execute such warrant.

(2) The Court of a Kadi issuing the warrant may also direct it to any person or persons by name not being police officers and such persons may execute the same.

(3) The police officer or other person executing the warrant, on finding the person to be arrested shall notify the substance thereof to him if so required shall show him the warrant or a copy thereof.

(4) When arrested, the person arrested shall be brought before the nearest Kadi without unnecessary delay but not beyond twenty-four hours excluding the time taken for the journey. The Kadi before whom he is brought may release the person arrested on bail as indicated if any on the warrant.

(5) Every warrant of arrest issued shall remain in force until it is either cancelled by the Court issuing it or executed.
