Section 95. Presumption of death.

(1) A Kathi may on the application of a woman issue to such woman a certificate of presumption of death of her husband-

(a)

if there is reason to believe that the said husband has died; or

(b)

if the said husband has not been heard of for such a period that it is reasonable to suppose that he is no longer alive.

(2) A certificate so issued shall be deemed to be a death certificate within the meaning of paragraph (b) of sub-section (1) of section 86.

(3) A certificate issued under sub-section (1) of this section shall operate as a certificate of divorce upon the particulars thereof being registered in the register of divorce.
