CHAPTER XIV - SENTENCES AND THE CARRYING OUT THEREOF



Section 129A. Power to suspend or reduce sentence.

(1) When any person has been sentenced to punishment for an offence other than an offence of Hudud Syarie and qisas, that is ta'zir, the Yang di-Pertua Negeri may on the advice of the Mufti, at any time, with or without any condition, or upon any conditions which the person sentenced accepts, suspend the execution of his sentence or remit the whole or any part of the punishment to which he has been sentenced.

(2) Whenever an application is made to the Yang di-Pertua Negeri for the suspension or remission of a sentence the Yang di-Pertua Negeri may require the convicting Judge to state his opinion as to whether the application should be granted or refused.

(3) If any condition on which a sentence has been suspended or remitted and in the opinion of the Yang di-Pertua Negeri not fulfilled, the Yang di-Pertua Negeri may cancel such suspension or remission, whereupon the person in whose favour the sentence has been suspended or remitted may be arrested by any Police Officer or Religious Enforcement Officer without warrant and remanded as ordered by a Judge to undergo the unexpired portion of the sentence.
