PART VIII - GENERAL



Section 138. Sanction.

(1) No prosecution of offences under sections 103, 114, 115 and 132 may be instituted without the sanction of the President.

(2) When a sanction for prosecution under subsection (1) is required, the Prosecuting Officers shall make an application to the President and give a brief report of the offence which can be proved together with any charge that is proposed to be brought.

(3) Although the sanction of the President has not been obtained, any person wha is accused of committing the offence may be arrested or a warrant may be issued for his arrest and executed and the person may be detained in custody or be released on bail.

(4) If a person is brought to a court, before the President has issued his sanction for the prosecution the charge shall be read out and explained to him, but he cannot give his plea thereto and the law for the time being in force relating to criminal procedure shall be modified appropriately.
