ENACTMENT NO. 3 OF 2001 SYARIAH COURT (TERENGGANU) ENACTMENT 2001
PART III - APPOINTMENT OF JUDGES AND JURISDICTION OF SYARIAH COURTS
Section 12. Jurisdiction of Syariah Subordinate Courts.
(1) A Syariah Subordinate Court shall have jurisdiction throughout the State of Terengganu and shall be presided over by a Judge of the Syariah Subordinate Court.
(2) The Syariah Subordinate Court shall-
(a) in its criminal jurisdiction, try any offence committed by a Muslim under this Enactment or any other written law which prescribes offences against the precepts of the religion of Islam for which the maximum punishment provided by such Enactment or other written law does not exceed three thousand ringgit, or imprisonment for a term of two years or both, and may impose any punishment provided for such offences; and
(b) in it civil jurisdiction, hear and determine all such actions and proceedings as a Syariah High Court is authorized to hear and determine, if the amount or value of the subject-matter in dispute does not exceed on hundred thousand ringgit or is not capable of estimation in terms of money (not including claims of hadhanah or harta sepencarian).
(3) The Duli Yang Maha Mulia Sultan may from time to time by order published in the Gazette extend the civil jurisdiction of the Syariah Subordinate Court.
