PROCEDURE IN CRIMINAL PROCEEDINGS



Section 25. Sommons and warrant.

(1) On receiving information of the commission of an offence within its jurisdiction to try, the Court may issue a summons against the accuse person in the form prescribed as Form A in the Schedule to this Enactment to appear before it, at a stated time and place.

(2) The summons shall state the general nature of the offence charged and the section of the Enactment under which it is punishable.

(3) If the accused has failed to obey a summons duly served on him, or if the offence is one punishable by imprisonment and there is good ground to believe that a summons, will be ineffective, whether by reason that the accused cannot be found or that he is likely to disobey such summons, the Court may issue a warrant in the form prescribed as form B of the Schedule to this Enactment addressed to the Chief Police Officer and all other police officers in the State requiring then to arrest the accused and produce him before the Couft. The accused shall be arrested and produced accordingly.
